How To Deal With A Government Checkpoint

With local, state and DHS checkpoints randomly popping up all over America many of our citizens believe that we must comply with what more often than not amounts to unlawful requests and orders from law enforcement officials.

While driving through California, Steven Anderson came upon three such checkpoints and he chose not to play ball with officers who asked him, among other things, to prove his citizenship, prove his identity and pull over for further inspection and questioning.

When asked whether he was a citizen Anderson’s immediate response was, “that’s my business.” When advised that it was the officer’s job to ask the question, Anderson calmly responds by saying, “I don’t have to answer you, because I have rights as an American.” The law enforcement official courteously asks Mr. Anderson to do him a favor and pull over for further questioning, no doubt expecting Anderson to comply. But not today, as Anderson patently refuses to do so per his Fourth Amendment Constitutional protections. He subsequently makes his own request, saying to the officer, “no thanks, I’d like to just go on my way.”

All of it was recorded on a digital camera in Anderson’s car and out of view of officers.

What you’ll see below is a crash course in exercising your Constitutional rights when faced with the threat of detention, interrogation and random searches by Federal or local law enforcement officials. You won’t see this one in mainstream media, and it’s something they certainly don’t teach in college:

Anderson: Is this Nazi Germany now, that I have to show my papers?

Officer: It’s a simple yes or no. I need an answer or we can detain you until we figure out whether you’re a U.S. citizen.

Anderson: Well, you know what’s more simple is the fact that my freedom is a little more important than you seem to think. Seting up checkpoints where people have to prove that they’re a citizen is not something that America is supposed to be about. So, I’m not sure if you understand that.

Supervisor enters scene: Grunt

Anderson: Grunt

Supervisor: Just pull up over there (points to line of detained cars)

Anderson: No, thank you… I want to go free on my way. Here I am just going about my own business and I don’t need to stop at a checkpoint to prove who I am because this is America. Correct me if I’m wrong – did I stumble into Mexico or is this still the United States?

Supervisor: This is the United States.

Anderson: Therefore, I should have the freedom to travel unmolested, because I’m in America here.

(pause)

Supervisor: Ok, go ahead and go.



Score one for liberty and the US Constitution.

It really is that simple.

Sure, some officers will overstep their bounds in an attempt to intimidate and instill fear, but in this case cooler heads prevailed and the officer in charge understood that Mr. Anderson was on the right side of the law, and that their requests for him pulling over and showing identification at a random checkpoint were nothing more than requests, as no such mandate exists without probable cause that criminal activity is taking place.

Mr. Anderson stood up for his rights – his own individual rights. To be free and to enjoy the liberties reserved and protected for the people by the Constitution of the United States it falls upon each of us, as individuals, to ensure the rule of law.

On another day Mr. Anderson may have been detained, perhaps even arrested (unlawfully).

But today in America freedom prevailed.

Good information, I have been through one Viper stop here in New Mexico, when stopped I asked was I free to go? He said that I needed to allow them to inspect my truck.

I did what the ACLU video says to do.

Am I under arrest? Am I free to go?

asked this 3 times in between him asking me to please cooperate with him,.

He then told me to get the f*ck out of there.,I still asked one last time 'was I free to go'

I must admit that it was a tense moment, but I felt good driving away.

Where is the media? They should be on this like flies on poop with their cameras. Any law enforcement person who agrees to participate in this type of intimidation has renounced their American citizenship in my opinion. They are all gutless wonders with no shame.

I think the Steven Anderson to which the author referred in none other than Pastor Steven Anderson, who has had a running battle with such authorities for several years.

Use a search engine and the terms "Anderson" "Minister" "checkpoint" "beaten". Pastor Anderson did not fare so well at every checkpoint he passed through! For example, http://www.freedomsphoenix.com...arrest.htm

GOD bless the man, may he continue his courageous efforts. May we too demonstrate knowledgeable courage in this face of tyranny, even before the "gloves come off".

UR the ONLYWAY? Ha! You're quite the drama queen yourself!You want to force him to embrace gays...
Just because the same government that conducts these searches endorses the gay lifestyle and enforces it that's OK with you!Obviously many people do not endorse making a spectacle of it complete with parades in underwear.
I have a question;
If gay men are sexually attracted to other men are they turned on by Jesus?
Do they think Jesus would be into man love?
Like when Jesus hugs them as they enter heaven.
Could they forgo their desires in the case of Jesus?
Y'know cuz he's Holy and stuff. I'm sure Jesus is a hot looking guy.He's perfect!Would they grab His butt?
It's just something that I was wondering about.
Something I need to ask a gay guy about and I figured maybe you would know.

I think what he did was GREAT, He stood up for his rights and these LEO'S seem to forget they are AMERICANS ALSO and what would they do if the shoe was on the other foot. In Az you can't even ask someone you know is here ILLEGALLY but you can demand an I.D from someone you know is an AMERICAN. Corruption has gone wild in the USA or should we now call it USSR.

Hershway - Rights are rights. You can't pick and choose which ones you like and only try to have those upheld. Gay people have a right to be gay. You don't have to agree with it, you just have to not discriminate against them. It is the same as your First Ammendment right to say what you just said. I don't have to agree with it, but I have to let you say it and respect your right to do so. Gay people don't want anything out of the ordinary. They want their basic Constitutional rights. The same ones straight people have. I don't think in the "Land of the Free" that is too much for them to ask.

Onlyway and those of that ilk have a right to be the queers they are but the other have a right for the queers to do it away from them and their families where their influence is only amongst themselves. I think Anderson is right in this regard if they do not want to isolate themselves.

Once it is court stamped and they do not refute the charges within a normal course of business it becomes a fact of law.
I believe if we do NOT start standing up to the tyranny, all of America will be subject to the "COPS" tyranny, brutality and abuse. It is high time we remember that they can be impeached by 2 witnesses in open court!
Striking against the constitutional for of government is TREASON! Stand with your friends in court and charge every officer who detains you with treason in open court!

Anderson did a great job but he could have been even more effective if he had in addition to what he was saying and recording, started asking them for certified copies of their Oaths of Office and Good Faith Surety Bonds. All public officials must take an oath to support & defend the Constitution and that means our RIGHTS to NOT be subject to an illegal search, among other rights. There are severe penalties you can bring down on these parasites by filing a Title 42 Section 1983 lawsuit on them and their departments and jurisdiction. any other day he would have been arrested, because the constitution is dead, the real ideals and quotes of our forefathers have been erased from the school history books, and I doubt that 10 percent of the american people know what the constitution is all about and know US and world history, and most americans have lost their critical thinking skills, and are scared of true freedom.

the question is 'are these checkpoingts legal". It is a simple question. Can they charge you with refusing to answer their inquiries?

Also, is it legal for them to detain you for refusing to answer questions, and also, what recourse is there for citizens who wish to see officers held accountable if they break the law by violating rights of citizens.
